By submitting an order, you are accepting the Terms and Conditions of the Flair web site.


Your details

a. When you register with the Flair web site, you will be required to choose a contact email address and password. You are responsible for all sessions and transactions taken under these details. You should keep your password safe and not disclose it to anyone. You should change it immediately if you feel it has been compromised.

b. If any of your details change, such as your credit card billing address, you must inform Flair as soon as possible. You may update your details by signing into your account on the Flair web site, and update the relevant section.

c. Where a Private Business Radio (PBR) UK General License for an item is required, by submitting an order for said item and providing the relevant information, you will be confirming that you have the correct licensing for the product, you are also giving Flair permission to inspect your certification.


The Contract between Us

a. Any contract for purchases made through the web site will be with Flair Business Equipment Ltd, whose registered office is Flair House, 112 Brooker Road, Waltham Abbey, Essex, EN9 1JH company registration number 2808361.

b. Flair must receive payment of the whole of the price for the goods that you order before your order can be accepted, and the contract formed. Payment is taken pre despatch of the goods to you from our premises in Waltham Abbey. Once payment has been received Flair will confirm that your order has been received by sending an email to you at the email address you provide in your registration form. The shipment email will include your name, the order number and the total price. Flair’s acceptance of your order brings into existence a legally binding contract between us on these terms. Any term sought to be imposed by you in your order will not form part of the contract. When placing the order you must advise Flair in writing of any special, legal, administrative or regulatory requirements applying in the territory in which you wish to import, use or sell the goods.

c. Flair is entitled to withdraw from any contract in the case of obvious errors or inaccuracies regarding the goods appearing on our web site. If an error or inaccuracy is discovered with regards to the advertised price of the goods that you have ordered before the contract is made (see (b) above) we will contact you as soon as possible by email.

d. The prices payable for goods are as set out in the web site, inclusive of VAT. Customers ordering for delivery outside of the UK will be responsible for payment of any local taxes payable and will be required to pay extra for delivery and clearance where necessary.


Withdrawal by You from the Contract

If you are an individual and are not buying goods on behalf of a business, there are certain circumstances in which you may withdraw from the contract and these are set out here. This right to withdraw does not apply to business buyers.

a. You may withdraw your order for goods at any time up to the end of the twenty first working day after you have received the goods. You do not need to give Flair any reason for withdrawing your order nor will you have to pay any penalty.

b. The only circumstances in which you cannot withdraw your order are where you have taken the goods you have ordered (or the ones in relation to which you want to withdraw) out of and removed any packaging in which they were delivered, we require any returned items to be complete including all parts, manuals and packaging.

c. To withdraw your order you must notify Flair in writing at the address set out in the Flair returns section of this Web site.

d. If you have received the goods before you withdraw your order then, unless you have lost your right to withdraw because you have taken the goods out of their packaging, you must send them back to the Flair contact address at your own cost and risk. If you withdraw your order but Flair has already processed the goods for delivery and you have received them, you must not unpack the goods when they are received by you and you must send the goods back to Flair at the Flair contact address at your own cost and risk as soon as possible.

e. Once you have notified Flair that you are withdrawing your order, any sum debited to Flair from your credit card will be re-credited to your account as soon as possible and in any event within 30 days of your order PROVIDED THAT the goods in question are returned by you and received by Flair in the condition they were in when delivered to you.


Availability of Goods You Order

If Flair has insufficient stock to deliver the goods ordered by you, we will notify you as soon as possible and any sum debited by Flair from your credit card will be re-credited to your account and Flair will notify you by email at the address given by you in your order form. The refund will be made as soon as possible and in any event within 30 days of your order. Flair will not be obliged to offer any additional compensation for disappointment suffered.

The web sight may from time to time give stock availability this is only an indicator (not a guarantee) on how long it will take us to ship your order.

If an item is out of stock with us at the time of your order, we will place an order from our suppliers. We keep in close contact with our suppliers and place orders with most of them on a daily basis.

PLEASE NOTE: We endeavour to bring our customers the best value we can by running special offers throughout the Flair web site, but please remember stocks are limited and subject to availability. Certain items may also be restricted to one product per customer, and this will be indicated on the web site. In these circumstances, we may amend your order prior to despatch. We update our web site as quickly as possible in order to minimise disappointment. The prices at which the goods are offered for sale are as displayed in your shopping basket.


Delivery of Goods to You

a. Flair will post, or arrange a courier on your behalf for, the goods ordered by you to the person and address you give Flair at the time you make your order. The consignee (i.e. the person to whom the consignment is sent) will be the declarant and importer into the country for which the consignment is destined. For non-UK destinations, the consignee will be responsible for both customs clearance and payment of customs duties and local taxes where required. Each item ordered will be treated as a seperate sale and will be shipped and paid for seperately.

b. Delivery will be made as soon as possible after your order is accepted and in any event within 30 days of despatch of the order. All delivery times quoted on the web site are estimates only, based on availability, normal processing and delivery companies.

c. You will become the owner of the goods you have ordered when the goods are dispatched to you from our premises.


Customs charges

If you are ordering goods for delivery outside of the UK, please note that your consignment may be subject to import duties and taxes, which are levied once the goods reach the country of destination. Any such charges levied in relation to customs clearance must be borne by you. It is accepted by you that Flair has no control over additional charges in relation to customs clearance. Flair recommends that you check with your local customs officials or post office for more information regarding importation taxes / duties that may be applicable to your on-line order. You will be the importer of record and responsible for any import VAT and duty that may be borne. In addition, any charges for import clearance will be borne by you, the customer.

Please note that when shipping goods from the UK, cross border shipments may be subject to opening and inspection by customs authorities. In respect of all goods dispatched to you to an address outside of the UK, you are deemed to be the importer of the goods and must therefore comply with all the laws and regulations of the country into which the goods are being delivered.


Liability

This is as follows:-

a. If the goods Flair delivers are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, Flair shall have no liability to you unless you notify Flair in writing at the Flair contact address. Notification of the problem shall be within 10 working days of the delivery of goods in question.

b. If you do not receive goods ordered by you within 30 days of the date on which they were despatched to you, Flair shall have no liability to you unless you notify Flair in writing at the Flair contact address of the problem within 40 days of the date on which the goods were despatched to you.

c. If you notify a problem to Flair under this condition, Flair's only obligation will be, at its option:- to make good any shortage or non-delivery; to replace or repair any goods that are damaged or defective; or to refund to you the amount paid by you for the goods in question to the original method of payment.

d. Flair will not be liable to you for any indirect or consequential loss or damage arising out of any problem you notify to Flair under this condition and Flair shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question under paragraph (c) above.

e. Nothing in this condition is, however, intended to limit any rights you might have as a consumer under applicable local law that may not be excluded nor in any way to exclude or limit Flair's liability to you for any death or personal injury resulting from its negligence.

Nothing in this contract creates any right which is enforceable by any person who is not a party to the contract.


Force Majeure

Flair shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond its reasonable control.


Invalidity

If any part of these conditions is unenforceable (including any provision in which Flair excludes its liability to you) the enforceability of any other part of these conditions will not be affected.


Complaints

Flair operates a complaints handling procedure which is used to try to resolve disputes when they first arise. If you have a complaint, please contact Flair in writing.


Governing Law

The contract between us shall be governed by and interpreted in accordance with English law, and the English courts shall have jurisdiction to resolve any disputes between us.


Warranty

All goods carry the manufacturers 12 month warranty. Should a product become defective please contact us to arrange replacement. Please do not return items to us without contacting us first. Repairs and replacements are usually handled direct by the manufacturer. Our warranty does not cover fair wear and tear, misuse or customer damage.

Entire Agreement

These terms and conditions, together with the current Flair Web site prices, delivery details and Flair contact details, set out the whole of our agreement relating to the supply of the goods to you by Flair. These terms and conditions cannot be varied except in writing signed by a director of Flair. In particular nothing said by any sales person on behalf of Flair should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale by Flair. Flair shall have no liability for any such representation being untrue or misleading.


Pricing and Payment

We accept VISA, MasterCard, Maestro (previously Switch)/Solo.

Your account will be debited and your order despatched at which point our acceptance of your order takes place.

Please ensure that the expiry date on your payment card is after the anticipated despatch date of your order as payment is taken on despatch. If the card has expired we will be unable to ship your order.

All charges are in UK Pounds.

All overseas orders will be charged in their respective currencies based on current exchange rates. Payment will only be taken from your card on receipt of your order.

Please be aware that prices displayed in your shopping bag are the current prices of the goods and the amount you will be charged for each item when submitting your order.

All prices on www.flair-uk.com are for online purchases only and may differ from prices quoted from Flair personnel.

Prices are subject to change without notice.


Unwanted Items

Please note that we no longer offer an exchange service on unwanted items. If you wish to exchange your order, please return the item for a refund complete with all Parts, manuals, and packaging and place an order yourself via the Flair web site for the alternate item. We are happy to refund unwanted items that are returned to us within 21 days. Please send the items to the address below and enclose a note quoting your order number, and stating that the items are unwanted, and you require a refund.

Flair-uk.com Customer Returns

For the return of high value goods, we recommend that you use a recorded delivery service, as we cannot be responsible for non-delivery of returned items.


Incorrect or Faulty items

Should you receive any items that you did not order, or that prove to be faulty, you can return them to the same address.

Please enclose a note quoting your order number and specifying whether you require the correct item to be sent out, or a refund.

All goods that are returned to Flair-uk.com are the responsibility of the customer and you may wish to send goods by registered post. We are not liable for goods that do not reach us.


Damaged items

If the damage is limited to standard cases, please visit the "Contact Us" page, email us with details of the damaged cases and we can send replacements out to you. If the damage affects the product itself or any non-standard packaging, please follow the instructions for faulty items.


Two Way Radio Returns

Under exceptional circumstances Two Way Radio’s in perfect condition, and with all the original packaging intact, will be considered for exchange for another item when accompanied by a Customer Advice Note and within 21 days of purchase.

Shipping

Each item on your order will be shipped out to you as soon as it is available in our warehouse.

Please ensure that your shipping address details are correct, as they are used exactly as inputted by yourself when submitting your order. We are not responsible for orders with incorrect or missing information should they not reach you.

You have a choice of Shipping Methods, and the following delivery times can be used as a guideline and will depend on stock availability.

UK Standard Delivery: This will be despatched with free delivery via Standard UK Mail. We would advise that packages usually sent by this method are received within 2-5 working days from dispatch.

UK Royal Mail Special Delivery: This method is fully secure and we can track and trace the order for you. Orders placed by this method should reach you on the following working day, though there may be delays. We will endeavour to ensure that goods leave our fulfillment centre on the day the order is received, providing the item is in stock or on the same day the goods reach us from our suppliers. However, goods despatched after 3pm may not be collected until the following day. Please note that goods despatched on a Friday will normally be delivered the following Monday. Goods despatched on Saturday / Sunday will normally be delivered on the following Tuesday. Orders sent via this method will require a signature upon receipt.

Standard Airmail: You will be charged a shipping cost for each item placed on your order - Europe £4, Rest of the World £6.20. Upon entering the shipping country, deliveries will enter the postal system of the country concerned. It is our experience that goods delivered using this method arrive within 5-7 days of despatch for European destinations, and within 7-10 days of despatch for the Rest of the World.

Overseas Courier Delivery: You will be charged a shipping cost for each item placed on your order - £30 Europe, £40 Rest of the World. Orders will be dispatched using Business Post International or similar. This method is fully secure, and we can track and trace the shipment for you. Orders placed by this method should reach you within 2-3 days of despatch for European destinations, and within 3-5 days of despatch for the Rest of the World. Orders sent via this method will require a signature upon receipt.

Delivery Costs

UK deliveries

Orders placed via Standard Delivery will be shipped to you postage free.

Orders placed via Royal Mail Special Delivery will incur a £5 postage charge per item.

Overseas deliveries

Owing to the many different combinations of items that may form an order, it is difficult to offer a universal shipping cost.

Interpretation

In these terms and conditions:-

'Flair' means Flair Communications Limited and Flair Business Equipment Limited of Flair House, 112 Brooker Road, Waltham Abbey, Essex, EN9 1JH, UK. Any connected organisation that actually supplies goods ordered by you and any successor to its business;

'Working day' means every day of a calendar year apart from weekends and statutory and public holidays;

'Us' means Flair and you together; and

'You' and 'your' means the person ordering goods under these terms and conditions.
